These terms and conditions govern the sale and placement of advertising in the Public Health Press Digital Magazine (the “Magazine”), which is made available, quarterly to NHS workers and contractors (the “Recipients”). By purchasing advertising space, the advertiser (the “Advertiser”) agrees to these terms and conditions in full.
The Advertiser is responsible for providing all content for the advertisement, including images, text, and any links, in accordance with the submission guidelines provided by Public Health Press. All advertising content is subject to approval by Public Health Press, which reserves the right to reject or require modification of any content deemed inappropriate, offensive, or inconsistent with the values and interests of the Recipients.
Payment for advertising space must be made in full at the time of booking, unless otherwise agreed in writing. Advertising space is not confirmed until payment has been received. All payments are non-refundable except as provided in Section 7 (Cancellation and Termination). Whilst all material and discounts provided for this magazine are aimed and highlighted towards the NHS and various Emergency Services Agencies, it must be understood that all advertising space is purchased directly from the publishers, Public Health Press, who are not part of the National Health Services nor have any connection or affiliation with any government body within the Healthcare or Emergency Service sector within the United Kingdom.
Public Health Press undertakes to present the Advertiser’s details within the Magazine and make the magazine available to the Recipients each quarter. The specific placement of advertisements within the Magazine is at the discretion of Public Health Press, although Advertiser preferences will be considered where possible.
The Advertiser agrees and acknowledges that Public Health Press undertakes to present the Advertiser’s details within the Magazine and make available the Magazine as stated, but cannot guarantee that Recipients will take advantage of any offer, service, or product proffered to NHS workers via the digital magazine. Public Health Press makes no representations or warranties regarding the effectiveness of the advertisement in generating business, sales, or leads.
The Advertiser grants Public Health Press a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, display, and perform the advertising content as necessary to fulfill its obligations under these terms and conditions. The Advertiser represents and warrants that it owns or has the necessary licenses, rights, consents, and permissions to use and authorize Public Health Press to use all intellectual property in the advertisement as described herein.
The Advertiser may cancel their advertisement up to 7 days after the reservation of a space in the publication by providing written notice to Public Health Press. In such cases, a full refund will be provided. Public Health Press reserves the right to terminate this agreement at any time, with or without cause, upon providing written notice to the Advertiser. In the event of termination by Public Health Press not due to breach by the Advertiser, a prorated refund of any prepaid fees will be provided.
The Advertiser agrees to indemnify, defend, and hold harmless Public Health Press and its affiliates, officers, agents, employees, and partners from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of the Advertiser’s advertisement, the Advertiser’s use of the advertising services, the Advertiser’s violation of these terms, or the Advertiser’s violation of any rights of another.
In no event will Public Health Press be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with these terms and conditions, the advertising services, the use of the Magazine, or any advertising content placed therein, whether the claim is based in contract, tort, negligence, strict liability, or otherwise.
These terms and conditions constitute the entire agreement between the Advertiser and Public Health Press concerning the subject matter hereof and supersede and replace any prior agreements and understandings between the parties. These terms and conditions may be amended by Public Health Press from time to time. The failure of Public Health Press to enforce any right or provision of these terms and conditions will not be deemed a waiver of such right or provision.
These terms and conditions shall be governed by and construed in accordance with the laws of England, Wales, and Scotland without giving effect to any principles of conflicts of law.
By purchasing advertising space in the Public Health Press Digital Magazine, the Advertiser acknowledges that they have read, understood, and agree to be bound by these terms and conditions.
